Liability Waiver Agreement

  1. Nature of Activity: The Participant is engaging in the following activity organized by the Organization: Trailweavers.

  2. Acknowledgement of Risk: The Participant acknowledges and understands that the Activity involves inherent risks, dangers and hazards, including but not limited to the risk of injury or death resulting from hiking in natural environments.

  3. Release and Waiver of Liability: In consideration for being allowed to participate in the Activity, the Participant agrees to release, indemnify and hold harmless the Organization, its directors, officers, employees, agents, representatives, volunteers, contractors, and affiliates from any and all claims, damages, injuries, liabilities, losses, or expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with the Participant's participation in the Activity, including but not limited to those resulting from hiking in natural environments.

  4. Assumption of Risk: The Participant acknowledges that he/she is voluntarily participating in the Activity with knowledge of the inherent risks, dangers, and hazards involved, and assumes all risks associated with the Activity, including but not limited to those resulting from hiking in natural environments.

  5. Medical Authorization: The Participant authorizes the Organization to seek emergency medical treatment for the Participant if necessary during the Activity.

  6. Media Release: The Participant authorizes the Organization to use, reproduce, and/or publish any photographs, video, or audio recordings of the Participant taken during the Activity for promotional, educational, or other related purposes.

  7. Governing Law and Severability: This Agreement shall be governed by and construed in accordance with the laws of the state of California, and any disputes arising out of or in connection with this Agreement shall be resolved in accordance with the laws of California. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  8. Acknowledgement and Agreement: The Participant acknowledges that he/she has read and fully understands this Agreement, and voluntarily agrees to be bound by its terms.

  9. Electronic Signature Consent: The Participant acknowledges and agrees that clicking the check button or any other electronic means provided to indicate agreement with the terms and conditions of this waiver is the equivalent of the Participant's written signature, and shall have the same legal effect as a written signature. By clicking the check button or using any other electronic means provided, the Participant affirms that they have read, understood, and accepted the terms and conditions of this Agreement, and voluntarily consents to be bound by its terms.
